TERMS AND CONDITIONS OF SALE

Recitals

The following provisions constitute the general terms and conditions of sale for the products offered by ATELIER PAULIN on its website at the following address: www.atelierpaulin.com. ATELIER PAULIN is an "SAS" (simplified joint-stock company) with a registered capital of €1,000 whose registered office is located at 9 avenue de Villiers 75017 Paris and is registered with the register of companies of Paris under the SIRET number 808 575 195 and VAT reg. no. FR37 808 575 195. By accepting the Terms and Conditions of sale, and by clicking "Confirm your order", you are formally confirming your order.

ATELIER PAULIN prevents the sale of products without the prior consent to the following clauses. 

ARTICLE 1

SUBJECT MATTER: The purpose of these terms and conditions is to define the terms of sale between ATELIER PAULIN and the client, covering the orders, the payment, the delivery and the services. They regulate all the steps needed to place an order and follow up this order between the contracting parties.  

ARTICLE 2

PRODUCTS: The purpose of ATELIER PAULIN is to sell its own jewellery and other fashion accessories subject to stock availability. These products are those listed for sale on the date of the consultation by the user. When the product is unavailable, it is displayed as "unavailable" on the site. If this is not the case as a result of an error, ATELIER PAULIN agrees to notify the customer by email as quickly as possible. If the product has already been paid, ATELIER PAULIN agrees to refund the customer the price of the article. The products offered for sale are described and presented as accurately as possible. However, if there are any errors or omissions in this presentation, ATELIER PAULIN shall not be held liable. The photographs and texts illustrating the products are not contractually binding. 

ARTICLE 3

PRICES OF PRODUCTS: The prices are indicated in Euros, inclusive of tax. They take into account the French VAT applicable on the day of the order. If the VAT rate should change, the changes are reflected in the price of the articles. ATELIER PAULIN reserves the right to change its prices at any time. However, these prices cannot be modified once the order has been confirmed. The prices shown do not take into account the shipping expenses which will be added to the total order value and will be specified to the customer during the final confirmation of the order. Deliveries to mainland France shall be fulfilled within an average period of 4 weeks from the receipt of the order by ATELIER PAULIN, notwithstanding any fortuitous event or force majeure event which would delay the delivery beyond ATELIER PAULIN's control and best efforts. The shipping costs depend on the country of delivery. The products remain the property of ATELIER PAULIN until the full payment of the price. 

ARTICLE 4

ORDER:
- REGISTRATION OF AN ORDER: Customers who place an order directly on the www.atelierpaulin.com site must follow the following procedure: Customers will choose the different products that interest them and click successively on the "Add to card/Add to my basket" link. At any time, they may choose between the following actions: View a summary of the products selected by clicking the "My Card/My Basket" link or continue shopping. Customers complete their orders by clicking "Checkout/Payment" in order to properly validate their order.

They then specify the chosen method of delivery depending on the country. Orders can only be registered on the site if the customer has clearly registered his strictly personal surname, first name, e-mail address and delivery address. Then the user must choose between a credit card or PayPal payment method and complete the data required for the method of payment chosen. A summary of the order will then appear with the following information: the type, quantity and price of the products selected by the user, as well as the method of payment chosen, the user's contact details and parcel delivery address. Each order shall be deemed acceptance of the price and description of products available for sale. The user may then enter the word or the first name, which will be used to personalise the bracelet, in the "Notes and instructions" field.

- ORDER CONFIRMATION: The order is confirmed once all the fields have been completed and the "Pay now/Validate" button has been clicked by the customer. ATELIER PAULIN will acknowledge receipt of the order when it is confirmed by e-mail.

ARTICLE 5

PAYMENT AND SECURITY OF THE TRANSACTIONS: The amount owed by the customer is the amount indicated in ATELIER PAULIN's order confirmation. In order to ensure the security of the payments, the atelierpaulin.com site uses the Stripe or PayPal secure payment service. Payment will be completed online on the www.atelierpaulin.com site by credit card (Bleue, Visa, or Eurocard/Mastercard) or by the PayPal account of the user. In any event, ATELIER PAULIN reserves the right to refuse any order or any delivery in the case of an existing dispute with the customer, of the total or partial non-payment of an order, of a credit card payment that has been refused or of other reasons that ATELIER PAULIN reserves the right to explain to its customer. ATELIER PAULIN shall not be held liable for the latter under any circumstances.

When the order has been confirmed, the payment request is routed in real time to the secure remote payment management system. The remote payment management system issues an electronic certificate. 

ARTICLE 6

WARRANTIES All non-personalised products may be exchanged or refunded. The exchange or refund should be made within a period of 7 days from the date of receipt or collection and the return of the article(s) within this period must be accompanied by the invoice of the article in its original packaging at the following address:

 ATELIER PAULIN, 208 rue Saint Denis, 75002 Paris.

The customer must make a return request by e-mail via the contact form on the page Contact us to obtain a return authorisation. Any damaged article, for which no remarks or reservations have been made by the customer on delivery, will be rejected. In order to be accepted by ATELIER PAULIN, items must be returned in their original condition and not have been worn. Only articles, which have been returned in their original packaging (fabric bags), will be accepted. As a result, returns of worn items and returns with damaged packaging will be refused. ATELIER PAULIN reserves the right to accept or reject the article returned depending on its state of quality. All articles are subject to a contractual warranty, which does not affect the legal warranty pursuant to articles 1641 et seq. of the French Civil Code. The user benefits from a warranty for the articles that allows him to return the said articles if they are delivered in a faulty condition pursuant to articles L 211-4 et seq. of the French consumer code.  

•The exchange: All the articles of the www.atelierpaulin.com site may be exchanged subject to stock availability. You just need to stipulate the article you would like in exchange in your return request. We will accept it on receipt of your return, depending on stock availability. If the value of the new order is higher, the customer must attach a cheque for the payment of the balance to the exchange request. Conversely, if the amount of the exchange is less than the initial amount, the customer will receive a refund of the difference directly to his bank or PayPal account depending on the payment mode selected by the user on purchasing the article.

To return an item, you just need to follow the following instructions: • Send an e-mail via the contact form and wait for a return authorisation. • Use the original packaging to return the product. • Send your parcel to the following address: ATELIER PAULIN, 9 avenue de Villiers 75017 Paris. In the case of an Exchange within France (and only for an exchange), the shipping cost of the second consignment will be provided free of charge.

• The refund: The refunds will only be taken into account in the event of a problem with the products delivered. If the product is defective, or a part breaks within 10 days, the refund may also be requested within a period of 10 days from the date of receipt of your claim, if it has been purchased on the www.atelierpaulin.com site. ATELIER PAULIN reserves the right to deem that a product is defective, as a result of the customer's explanation. The product will be considered defective if there is a clean break of the metal wire without any observable abnormal deformation of the letters of the bracelet or any sign that the metal wire has been cut by a sharp object. ATELIER PAULIN agrees to refund the article within a maximum period of 30 days by credit card or by cheque according to the customer's choice. If you want to obtain a refund for your article, send an e-mail via the contact form. Specify your surname, first name, phone number, order number and the reason for your return. Return the parcel by post to the logistics centre of ATELIER PAULIN at the following address: ATELIER PAULIN 9 avenue de Villiers 75017 Paris. Please note that we do not accept parcels which are sent carriage forward. Please note: You will be refunded the amount of your order net of the initial shipping costs. The customer must however return the article as is in its original packaging with the authorisation of ATELIER PAULIN and its return number included in the parcel, which establishes the date of the dispatch. In any case, all exchange or refund requests must be made by e-mail via the contact form. All articles are subject to a contractual warranty, which does not affect the legal warranty pursuant to articles 1641 et seq. of the French Civil Code. 

ARTICLE 7

INTELLECTUAL PROPERTY: All the elements of ATELIER PAULIN’s site, such as the products and images, including the underlying technology, are protected and legal proceedings will be instituted against any fraudulent use. They are the exclusive property of ATELIER PAULIN. Users who have personal websites and who, for a personal use, wish to place a simple link referring directly to ATELIER PAULIN's website on their website must seek prior consent from ATELIER PAULIN. Furthermore, any hypertext link that links to the ATELIER PAULIN site, especially using framing, deep-linking, in-line linking or any other deep link technique is formally prohibited under all circumstances. In any case, any link, including tacitly authorised links, must be removed on request by ATELIER PAULIN. Hypertext links may be directed towards websites other than www.atelierpaulin.com. The latter shall not be held liable if the content of these sites violates applicable laws and regulations 

ARTICLE 8

DATA PROTECTION AND PRIVACY: For the purposes of its business operations, ATELIER PAULIN reserves the right to collect personal data relating to the users of the site, using "cookies" in particular. The consumer represents that he is aware of this. To this end, the automated processing of data, including the management of the users' e-mail addresses, was declared to the CNIL (French data protection agency) under the number 1840453. In any case, and in accordance with the French law of 6 January 1978, the consumer also has a right to access and correct any information contained in the files of ATELIER PAULIN. Any customer of the website may at any time object to the commercial use of the said data and has a right to access, correct and delete their personal data, directly on the internet using the contact section of the site.

 ARTICLE 9

SIGNATURE AND PROOF: In any case, the user will be deemed to have confirmed the order on entering the credit card number online. The latter will be considered to constitute proof for the entirety of the said order in accordance with the provisions of the French law of 13 March 2000 and will cause the sums incurred by the articles entered on the purchase order to become due and payable. This confirmation shall be deemed to be equivalent to the signature and express acceptance of all the operations performed on the site. However, in the event of the fraudulent use of a credit card, the customer must contact the customer service of ATELIER PAULIN by sending an email to contact@atelierpaulin.com as soon as they become aware of this event. The computerised records, stored in the computer of ATELIER PAULIN and its partners under reasonable conditions of security, will be considered as evidence of the communications, orders and payments between the parties. In every case, the confirmation of the order by the credit card payment completed directly on the site shall be deemed to be equivalent to the signature and express acceptance of all operations performed on the site. 

ARTICLE 10

CUSTOMS DUTIES: Any order placed on the site and delivered outside of France may be subject to taxes and customs duties which are applied when the parcel arrives at the destination. Such customs duties and taxes associated with the delivery of an article shall be borne by the customer and be the responsibility of the customer. ATELIER PAULIN is not obliged to check and notify its customers of any applicable customs duties and taxes. To obtain this information, the member must make enquiries with the competent authorities of his country.

Disputes/APPLICABLE LAW The original language of these terms and conditions of sale is French. The present contract is governed by French law. In the event of a dispute with a client, the only competent courts shall be the French courts. 

ARTICLE 11

ENTIRE AGREEMENT: These terms and conditions of sale and the summary of the order sent to the client constitute the entire agreement between the parties.

ARTICLE 12

DELIVERY: The products are shipped with a supporting invoice, to the delivery address specified by the customer when placing his order. All orders confirmed before 1pm are shipped within 48hrs.

The stated delivery times provide an indication of the lead times from the day after the order is confirmed by the customer and correspond to the time needed to process and deliver the products. Under no circumstances are these lead times binding upon the company. However, you will be sent an e-mail in the event of an unusual delay. Consequently, ATELIER PAULIN shall not be held liable in the event of an excessively long lead time owing to the postal services or means of transport, and in the case of the loss of the products ordered or strike action. The transport risks shall be borne by the customer, who shall formulate a reasoned claim with the postal services or with the carrier, within three working days of the delivery.

This being said, despite the best efforts of ATELIER PAULIN in preparing the parcels, a product may be missing from the parcel. Similarly, after transporting the parcel, one of the products may be defective. That's why, on reception of his order, the customer must check the compliance of the products received. ATELIER PAULIN's customer service must be notified by recorded post (sent to ATELIER PAULIN 9 avenue de Villiers 75017 Paris) of any anomaly with the delivery (missing or broken product or damaged parcel) on the day that the parcel is received and no later than the first working day following reception.

Any claim submitted after this deadline will be rejected and ATELIER PAULIN will be released from any liability. ATELIER PAULIN may ask the customer to return the defective product. If the aforementioned conditions are met, ATELIER PAULIN will then exchange or refund the defective product(s), or re-dispatch the missing product (provided that the buyer's request is well-founded). 

DELIVERY LEAD TIMES AND RATES: The specified lead times provide an indication of the delivery lead times of our carriers in working days added to the production time. All prices are in Euros. The tracked Colissimo is delivered by La Poste within 2 to 8 working days (for mainland France). It is delivered to the delivery address indicated on your order slip.

In the event of your absence, the postman will leave a delivery notice specifying the instructions for collecting your parcel (place and time). The official lead times are generally 15 days. You can track your parcel on the www.coliposte.net site.

In order to obtain your Colissimo tracking number, please send an e-mail via the contact form stating your surname, first name and order number. If you have not received your tracked Colissimo after 10 days and you have not received a delivery notice, remember to check the status of your parcel on the coliposte site (and contact us by e-mail via the contact form)

Damaged parcel: Do not accept a damaged parcel (carton bearing visible signs of opening and/or damage): it must be refused. Indeed, the parcels that leave ATELIER PAULIN's warehouses are always in perfect condition, and must be delivered to you in the same condition. If a damaged parcel has been delivered to your letterbox or is received by your caretaker, the parcel shall be deemed "accepted as is". If no reservations are made, we will not be able to consider any claims for missing products or proceed with any compensation payments.
